What is the Charge of Vehicle Code 14601.2?

California Vehicle Code 14601.2 is a California Traffic Misdemeanor alleging that a person drove when their license had been suspended because of a DUI.  In order to prove this offense the prosecution must show the following elements.

  1. The defendant was driving
  2. At the time he/she was driving his or her license had been suspended
  3. The license suspension was because of a DUI arrest or conviction.
